City Council Meeting Minutes


The regular meeting of the City Council, City of Metropolis, Illinois was held at 7:00 p.m. on Monday, January 9th, 2012 in Council Chambers of City Hall at 106 West 5th Street, Metropolis, Illinois with the Honorable Mayor Billy McDaniel presiding. Upon roll call the following Alderpersons were present: Richard Corzine, Charles Barfield, William Carrell, David McManus, Robert Midnight, Jerry Mizell, David Daughtery and Kim Brown, Corporate Counsel Rick Abell, City Clerk Jan Adams, and concerned citizens of Metropolis

The meeting was opened with the Pledge of Allegiance followed with Prayer led by Mayor Billy McDaniel

CITIZENS REQUEST:
Julian (Butch) Adams came before the Council with concern about the loose poles on Market Street, a light out on the corner of 8th Street and asked that the trees be trimmed along Market Street. The Mayor stated the City has already had the tree trimming on the schedule for this week, and thanked him for the rest of the information and will have these items fixed.
Steve Chaney showed his concern for the Fire Department cuts. He stated there was a fire that broke out while they were attending a first responder’s call and asked if the City could grant Chief Jason Morris to hire more volunteer firemen and was told the Council has already given him permission to hire 8 on call and he was just trying to hold off knowing the City was in a budget crunch and trying to avoid layoffs. Steve and Alderman David Daughtery commended the Fire Department for doing a great job. Steve had commented he was on his 7th year living in Metropolis and wants to express that with the New Year comes new opportunities for economic growth and development. He wants the Council to remember as they vote on motions that are governed of the people, by the people but to remember it’s for the people as they make their decisions. The decisions affect us, all of us.



Mayor’s Report:
Mayor McDaniel explained the delay on the demolitions the Council has approved was due to the new process Atmos is shutting off gas lines. The City was allowed to shut off the gas lines on the property and cap it after the demolition was complete; now the gas company is digging up the line at the street and capping it off there. This will now create a two to three week delay for demolition to be completed.


CORPORATE COUNSEL:

Corporate Counsel informed the Council on the New Open Meetings Act for Public Officials they are required to take. The new act goes into effect January 1, 2012 and requires all elected and appointed members of a public body to successfully complete the electronics training program provided by the Illinois Attorney General’s Office. This will apply to members that are subjected to the Act; the Mayor and City Council members along with our Committees, the Library Board, the Airport Board, the Tourism Commission, the Planning Commission, the Zoning Board of Appeals, and the new Insurance Committee. Once completed the certification of completion will be turned into the City Clerk’s office.


Corporate Counsel passed out information on the litigation between IMEA and Ameren regarding Ameren’s wholesale distribution rate. Alderman Richard Corzine asked if we could expect a rate increase and if so saying we need to inform the public. Abell told him he didn’t feel we would and if the rates would change a 90 day notice to all municipalities would be sent before going into effect; adding we have a long term contract with Ameren that has perimeters on it. He went on to explain the rate may not have a major impact on the individual members in IMEA or their customers but it’s worth fighting over for the IMEA overall.

Properties from the Condemned meetings and approved at a prior Council meeting were discussed; 107 E. 7th Street has signed an agreement to make repairs by the end of March. Photos from 511 E. 8th Street were passed showing improvements made but it was the consensus of the Council to continue legal action and Alderman David Daughtery commenting if we just let things go like this, it’ll just continue and continue and other ones will follow suit.

Introduction of a new Ordinance for noise was brought before the Council. Corporate Counsel said we have ordinances on nuance and disorderly conduct but nothing pertaining just to noise. Adopting this will allow our Police Department more authority.

Alderman Jerry Mizell wanted to acknowledge the effort and persistence of the group Save the Massac Theater. They have been diligent in their effort since 2005 and will see the results soon.

Lisa Gower wanted to thank the Council for the willingness to see the vision and to believe in the group. They feel it will be a draw for Metropolis.

CITIZENS REQUEST:

Wilbur Belford came before the Council questioning the electrical controls for the Woodhaven area and was told Russell Electrical will seal the control boxes that run the lift station to make them water tight. The governing factor is that
Woodhaven is a flood prime area and have underground transformer services.


Mayor’s Report:
Mayor McDaniel acknowledged the retirement of Jackie Sawyers with the Light Department after 33 + years and Randy Harris with the Street Department after 21+ years of service with the City. They will be missed by everyone. They have been dependable, polite and easy to work with. They have worked in all kinds of weather and after hours until the job was done. Jimmy Sullenger will take Randy Harris’ place and Jackie’s position will not be filled at the current time. Keith Stokes will remain lead man. The light department has team players and will pull together during this transition.

Their last day with the City will be December 30th, 2011. The Metropolis Police Department will be losing Linda Rick after 20 years of dedicated service. Linda’s last day with the City will be January 8th. 2012.

Ron Jones President of Mutual Medical, David Andreas Senior Consultant with Mutual Medical Plans Inc, www.mutualmedical.com and Jeremy Billington with Billington Insurance Agency Inc, Jeremy@billingtoninsurance.com came before the Committee to discuss money saving options for the City’s Insurance Policy. Mr. Jones told the Committee it is his job to create a plan according to what you want to pay and how much you want to save. He showed the Committee the prior BC/CS policy book consisting of about 100 pages and informed everyone they would receive a 9-12 page policy booklet easy to read with all the benefits explained. The City choosing to accept the self-funded policy Mutual Medical as presented will go into affect December 31st 12:01 a.m. All claims pending after January 1st, 2012 will be paid by the old carrier, Blue Cross/Blue Shield. Dental and Vision will still be provided. He will make a draft policy according to the feedback from the handout sheets today and will make any revisions necessary before the final draft. The policy will be drawn up how we want it and according to how much we are willing to pay out for claims. Mr. Jones went over the considerations with the Committee and explained which costs the City more and why, and which things to eliminate entirely. We were told we could change things at anytime or see in 6 months what the cost factor is by keeping things we have now. The Committee felt we had made progress and will meet again to go over the draft Mutual Medical will create from this meeting. December 28th, 2011 @ 3:30 will be the next Insurance meeting.

CITIZENS REQUEST:

Charles Eichorn came before the Council with questions and concerns on annexing his property and City insurance. Charlie asked whom should he contact for annexing into the City and was told Chad Murray with Mapping and Zoning. He added he would like to see this take place soon, with the understanding you must live in the City limits in order to run for office if he chooses to do so in the 2013 election. Charlie made it clear if he chose to run for office he would not want the insurance provided by the City adding the question; if he won would he be forced to take it. Charlie felt it should be given back to the City to save jobs and the City money so we could meet these budget cuts and help out the County again. Corporate Counsel told him it was a requirement in the other insurance carrier that was a stipulation, not of the new group, Mutual Medical the City is about to make a motion to accept. Charlie was told the Council makes the decisions in our City.


Mayor’s Report:

Mayor McDaniel informed the motion for the snow plows is for the hydraulic system on the blades in the amount of $1,759.25 and for the lights in the amount of $199.96

Mayor McDaniel stated we had 4 different quotes for the job and Chuck Short came in the lowest bidder. All building materials will now be mandatory they go through our transfer station and will give the City $1.35 a ton.



The Mayor reminded the next Council meeting will be after the Christmas holiday on Tuesday December 27th, 2011 @ 7:00 p.m.

CORPORATE COUNSEL:


Corporate Counsel made a few points to the Council and the Citizens about the motion to accept Mutual Medical Insurance Group. The City will save jobs and money it’s a win win situation. He added our employees are nervous about cuts so we need to be sensitive to their feelings. We take all suggestions on how to save and keep our employees jobs. It has been said “why don’t we stop the electrical conversion saving $625,000.00 adding the rumor is spreading the contractor will come back at a later date for the same price. Corporate Counsel informed everyone we are more than half way through Phase -1, we started this project $1,000,000.00 under budget and can get rid of the West Side Substation, going from an outdated and inefficient 4KV system transformer. We can’t’ afford for this to go out on us in the summer months, our citizens are at a bigger risk if we didn’t do it.

Corporate Counsel handed out the Ordinance to the Council explaining it’s only a rough draft and will make any changes needed. We can take it back to Insurance or Ordinance Committee for discussion. He feels it’s a starting place and a needed Ordinance. Mayor McDaniel added he felt comfortable everyone at each department in the City understood the new policy and all the questions and concerns have been answered by Mutual Medical. He thanked everyone involved who have put in countless hours making this happen for the City of Metropolis, helping save thousands of dollars.

Mayor McDaniel informed the Council Kathy Benard with Mapping and Zoning will be laid off as of December 31st, 2011, she will be missed and we wish her and her family well.

Corporate Counsel:
Corporate Counsel explained to the Council the information given to them was from Mutual Medical Insurance, the company the City has met with and was getting quotes from. This material was references and graphs on a 10 year survey on average costs of insurance in the Midwest, showing a comparative savings for our City. Mutual Medical also had a total annual fixed cost, claims cost and plan cost summary comparing BCBS to themselves.

Corporate Counsel addressed the Council on the Donco case stating we had been in the lawsuit since 2006, the work Donco had done for the City was back in 2005. After a lot of struggles and effort we have gotten in the range the Council requested to settle and once approved we will put this behind us.

The Council talked about the time length to add on the upcoming Ordinance on Absenteeism, most felt 6 months would be a sufficient time to know if you were able to come back to work, keeping in mind Family Medical Leave gives 12 weeks.
They all felt a year was too long of time to have the City pay the employee to be home. Alderman Corzine added he felt 9 months would be better and made the motion to adopt. They all felt it best to bring back to Ordinance Committee for further discussion.

FIRST READING ON AN ORDINANCE AMENDING FAMILY MEDICAL LEAVE ACT POLICY:

Corporate Counsel wanted to express to the citizens of Metropolis the City Clerk’s office / Light Department was not going to shut off the power at the Massac County Court House. The article in the Paducah Sun made it appear the lights would be cut on November 14th, 2011 without payment. The notice they received was a standard late/disconnects notice sent to all business and residents who overlooked the bill. The notice is a second reminder; the Clerk’s office even calls local businesses and government units before it comes to that. We have a payment plan for anyone who needs it. We recognize the County is having a rough time right now in this economy and have always had a good relationship and will continue to do so. Small and large businesses have gotten these slips in town but we call before the lights are actually turned off. Communication is the key. Rumors will not take hold if when you heard that you just say no that would not be done.

MISCELLANEOUS REPORTS:

Mayor McDaniel had commended Fire Chief Jason Morris on running the department shorthanded and doing a great job. He also acknowledged he had no overtime and knew it would be a strain but still continued to follow the direction of the Council.
Sheryl Durham wanted to introduce the new SITN director, Sonia Windhorst to the Committee and to say we are looking forward to working with her and feels the Board of Directors made a wise choice. Her office will be at the Metro Chamber of Commerce. Sheryl added the 200th Anniversary Steamboat Celebration this past weekend was a huge success, the Belle of Cincinnati docked at Fort Massac State Park and thanks to the reception they received the owner B.B. Riverboats would like to see it become an annual event.
Sheryl also had addressed the Blues n Ques annual event, adding they are still waiting to hear back from vendors. Changing the event to an earlier time in the year was discussed with pros and cons for each. All agreed having it to close to Paducah’s same annual event is not the best decision. As information and dates develop the Council will be kept informed.
The Labor Day festival was also discussed, the parade is enjoyed by all with a large turnout, but the events we host at Fort Massac State Park attendance is down over the years. The cost on the City to host these events will be discussed in a Committee meeting at a later date.

Renaming 5th Street was mentioned, American Way is to be the honorary name given to the main street, and will be brought up in a Committee meeting as well.

New Business:

Alderman William Carrell had asked the Mayor to explain where the money was coming from for the Sports Park walking paths. He wanted it know considering the City is in a money crunch it was not a City funded project. Mayor McDaniel explained the money for the sidewalks at the Sports Park came from a grant that is connecting fields 3,4,and 5 together. This grant came about after the first grant given fell though due to political reasons. We received $48,500.00 for improvements of our parks and the work is being done by our own employees to save money.

Alderman David Daughtery wanted to show support to Brian Wimar on his new business, Super Brothers Detailing located at 712 West 7th Street, (618)524-1400.

Corporate Counsel:
Corporate Counsel made a public announcement about the dumpsters at the Community Center; they were there for dumping due to the flood and are no longer there nor will they be back. He commented that people are still using that area for dumping and the City will have to start writing tickets if they are caught unloading and dumping trash.

Citizens Request:
Charlie Eichorn addressed the Council thanking them for their time. He wanted to congratulate the Council on voting “yes” for the Liquor by the Drink motion on the agenda. He is excited about seeing this new ordinance come forward for growth of Metropolis. He feels this will bring in more revenue and hopefully a new business to town that otherwise would not have considered Metropolis. This might bring in growth, change, more tourists and more revenue for all areas of our town. Charlie added he wants to see more development in town. He is for seeing Metropolis continuing to thrive and grow. We are taking small steps in the right direction. He expressed he doesn’t want to see our citizens having to spend money in Paducah or other places when we could keep it in our town. Charlie read a quote from the Governor that utilities are the key to economic growth and development they are the key to retaining business and the key for attracting new business. What really brings me to this meeting is the PPA he said. He asked who is the Chairman on the board; Alderman Charles Barfield answered he was. The purpose of the PPA Alderman Barfield explained is what we pay for electricity. We never have left over electricity we bill out the 10th, 20th, and the 30th of every month. This has been an exceptionally hot summer which has caused high bills for everyone. Corporate Counsel explained to Charlie and the other citizens present the power and fuel fluctuates so we can’t have the same PPA rate every month. Since 2007 the rate for the City to purchase electricity has been on the rise. There was a rate freeze for 10 years and the rates were the same for all but now that has been lifted. We put on the PPA to cover our losses and not have the City lose money. The PPA was put back on in 2006 based on audits, after losing up to $500,000.00 a year. Mr. Eichorn asked about the construction with the new poles all over town, who pays for that? Corporate Counsel continued to explain; we pay for that as we go. Charlie said there is a budget crunch everywhere, in our county, business and our state. He added one year ago he did a FOIA request on our health insurance and asked for a committee to look into this and no action was taken. It has always been in question if the Council was a City employee which makes them eligible for health insurance paid by the City. Is there an Ordinance to support this ruling for them to receive the insurance? The Alderman need to make a decision as to whether they are or are not City employees eligible for insurance. We need to take a look at what is going to help the City and clean up in-house first. Charlie asked did any of you make a sacrifice; and said he was not picking on anyone but merely saying something needs to be done. Charlie asked the Mayor his duties in a conversation and he replied to enforce the Ordinances. Charlie felt the insurance issue is being abused by the Council.
Alderman Richard Corzine asked how long we have insurance as Alderman provided for us. Corporate Counsel answered the compensation can be set at anything you want to set.

Ray Vaughn came before the Council and expressed his gratitude for the lights being fixed at the Veterans Park. They made a great difference, Thank You.

Butch Adams came before the Council with information on the Feed the Children program he supports. There is a special code for the project # 1TSJFN004. By putting this on your donation all funds can be tracked and the food will stay local. It is very important to include both that code and ATTN: SPECIAL PROJECTS DEPT. ON BOTH CHECK AND OUTSIDE OF ENVELOPE. One semi-truck load of food is $7000.00 until 2012 then the cost will be $8,200.00.

JL Wilkins wanted to inform the Council they had a good Sunday after opening with the new Liquor by the Drink Ordinance. It was a different kind of crowd that came to eat and enjoy the food. We also saw the crowds came in groups and we sold more food than liquor. We have 76 seats not including around the bar and had all the seating filled. It was a good day. Mayor McDaniel thanked JL for the information and stated he was glad business was good, that was the intention behind the ordinance. JL wanted to say he was sorry the package liquor was not part of the ordinance because a few of the business were not going to reap the benefits of Sunday liquor sales. He added the Metro Pony and the Casino advertize which brings in business to Metropolis. Even if you don’t care for the business tax dollars are still being brought into the town.
The Mayor also said if it keeps people employed or allows a business to hire more employees due to the higher revenue coming in that makes it worth passing. Corporate Counsel stated he had talked to Corey Bowman from Willy Jaks and had about the same report as JL representing Tailgators. They kept a steady crowd up until they closed around 8 and was pleased with the first Sunday opening. They met their food sales and saw a different crowd come in. They socialized and ate then left.

Ray Vaughn also wanted to say the annual fish fry was a success even through the rain and was pleased to see the turnout.

Keith Davis had told the Council that the hard and soft ware vendors will do the installation at no charge and to remember we are getting a grant to help offset the costs.

OLDBUSINESS:

The Blues n Ques weekend was a Success! We had no injuries and lots of compliments. We couldn’t have asked for better weather; there were lines at ever vendor and the craft market had good attendance. They would even like to see more craft events next year and not as much flea market type vendors. The input from our newest vendors was they will be back and felt they were welcome and loved the town. The weekend brought in a lot of tourism and revenue to the City. We are working on something new with the KCBS. We would like to see the event in the late spring or early summer. Will work out the details and dates and keep everyone informed.

NEW BUSINESS:

Sheryl Durham with the SITN informed the Council they had 25 interviews and will start the process after the Encampment was over. She also informed everyone of the upcoming event the annual Fort Massac Encampment starting October 15th and 16th. For more information about Metropolis area events, attractions and lodging, visit www.metropolistourism.com or call Metropolis Tourism at 877-424-5025. It is great food and fun for everyone to enjoy. She stated we have petitions out there to sign stating we want to save the fort in the park. She also commented IDNR has not heard enough input from the people to save it.


Alderman Corzine asked when the insurance was up for renewal or to renegotiate the contract. Mayor McDaniel said the City will research insurance options for hospitalization; workman’s comp and property/casualty comp for the upcoming year. Alderman Corzine stated that the health insurance seems to be the biggest issue. Corporate Counsel says we need to allow 6 months to get a bid, because of all the information we have to provide.

There will be more advertisement on this in the near future. ORDINANCE COMMITTEE:

Alderman William Carrell had read before the vote on the liquor by the drink ordinance as follows;
The last several months the same 1-6 advocates of alcohol sales on Sunday have attended the council meetings.
Their desire is not to have a drink with a meal on Sunday, but simply be open with alcohol available for consumption on Sunday.
The ordinance 50% of revenue must come from food sales and alcohol may be served with a sit down dinner.
If the ordinance is not enforced as a food establishment with sit down dinner providing an alcohol rink with the meal, it then becomes an open bar.
Who will enforce this ordinance?
In supporting the majority of my constituents, I will keep my word and vote no on alcohol sales on Sunday. Alderman Jerry Mizell wanted it to be known his personal feelings on the Sunday alcohol sales as well. He told the Council and Citizens present he was against the ordinance but will vote for the good of Metropolis. He struggles with his decision of the vote saying they always go to Paducah to eat after church and it bothers him when he sits near someone drinking on the Sabbath.
The Mayor stated that the law still applies on Sunday Liquor by the Drink if the ordinance is not followed we will still follow protocol by sending a letter, then a fine and if it still persists the license will be removed. He also said it was not mandatory for any restaurant or bar serving food to open on Sunday, this is by choice only ordinance.

Citizens Request:
Charlie Eichorn addressed the Council thanking them for their time to listen. He stated he is for seeing Metropolis grow and will always come up with new ideas to help see this happen. He is excited about seeing the Liquor by the Drink come forward for a vote. He feels this will bring in new revenue and hopefully a new business to town that otherwise would not have considered Metropolis. He wants to see change, more tourists and more revenue. Charlie added he wants to see more development in town; it saddens him to see our citizens having to spend money in Paducah or other places when we could keep it in our town. Charlie also brought up the cost of insurance; wondering if we could bring costs down to lower the City budget. Electricity and the cost of it was the real reason Charlie came before the Council. He was explaining his light bills were continuing to increase and wants the City to look into how we manage the rates by having a study conducted. He expressed his concerns for our citizens and how they will meet these high bills. Charlie asked if we could sell back the electricity that we didn’t use, even at a lower rate to help. Corporate Counsel Rick Abell who is on the board of the IMEA answered, we can’t sell back the electricity but we do use it, nothing goes to waste. Abell added we meter on a 30 day basis but that doesn’t coincide with our 30 day billing cycle. The City bills out on the 10th, 20th, and the 30th of the month so that covers all the electricity that we purchase. Corporate Counsel told Charlie the City previously hired a firm to evaluate the best option for the City use and purchase of electricity. The public is welcome to see its findings. The PPA was taken off of the residents of Metropolis light bills because of the gaming revenue made up the difference, but with the declining income from the boat in 2006 the City was losing almost $500,000.00 a year and felt they needed to bring it back.

J.L. Wilkins came before the Council adding he has his own business and can appreciate what Charlie said this evening. J.L. said if the City doesn’t know all there is to know about our electrical rate to please look into it. He also wanted the Council to ask themselves before they approve and adopt motions to make for sure they know all there is to know about the project and to make for sure that was the best quote for the City; have a building inspector to look at the plans would be one way to insure this.

Kitty Gullett an employee at The Grill located at 310 Ferrry stated she felt adopting the ordinance Liquor by the Drink will benefit Metropolis, adding they get several requests for an alcoholic drink with their meal and has to turn them down. She feels some of the residents or tourists go to Kentucky just for this purpose.

Mayor Billy McDaniel addressed the Council with an update on Bulldog trash items. There is a list posted at City Hall of items no longer accepted per the Illinois Environmental Protection Agency. We need to have a drive to pick up old unused appliances. Our landfill will be full if we just allow dumping and we don’t want to see these items in our ditches. We will work out the detail and keep everyone informed.



Corporate Counsel:
Corporate Counsel had passed out to the Council a memo update on Donco and Dippin Dots Store.

I also ask that the Finance Committee take a closer look at the charges from Mr. Bergthold firm for the month of February 2011 to determine if the City should have paid for the services for that month due to the fact the charges may have been part of the flat fee agreement made with Mr. Bergthold in the agreement signed by the Mayor on or about Dec. 1, 2010.”

Mayor’s Report:

Mayor Billy McDaniel addressed the Council with pictures of graphic vandalism of the new picnic tables at the City’s Parks. The Metropolis Police Department will continue to stay on this matter. Mayor McDaniel said our parks are for the families of our community to enjoy and it’s a shame when you take your children out to play or grill as a family and this is what is on our tables. We have cleaned the graffiti off and hope it doesn’t happen again. The City would hate to put hours of operation time on our parks; they are for all to enjoy the Mayor added.

A hearing testimony is held with the Planning Committee they will listen, ask questions, and weight out the facts and makes the decision; once this is done no new evidence can be brought to review. Alderman Jerry Mizell applauds Ms Graces effort, it was a great idea just the wrong place and the neighbors were only looking out for their neighborhood adding he wished she would have looked into this before she bought the building. Corporate Counsel agreed with Alderman Mizell thinking that was a great point to bring up. We need to educate our citizens in this matter and seek Mapping and Zoning along with the Planning Commission to see if they meet the appropriate requirements. We don’t want people to go out and buy the property without checking to see if they can proceed with the plan of business. We also want to make people aware just because it was once considered commercial it may not be now. The Mayor wanted to commend Chad Murray, Administrator of Mapping and Zoning, for the excellent job he did with this job.

Frank at the WWTP just reminded the Council the repairs for the Flow Meter will be picked up by FEMA.

Head Lineman Keith Stokes informed the Council the forklift was delivered last Monday and is going to benefit the City.

Director of Tourism Sheryl Durham announced the Super City Quilt City Connection will be held September 10th-11th at Harrahs Riverfront Event Center.

The regular meeting of the City Council, City of Metropolis, Illinois was held at 7:00 p.m. on Monday, August 08th, 2011 in Council Chambers of City Hall at 106 West 5th Street, Metropolis, Illinois with the Honorable Mayor Billy McDaniel presiding. Upon roll call the following Alderpersons were present: Richard Corzine, Charles Barfield, William Carrell, David McManus, Robert Midnight, Jerry Mizell, David Daughtery, Corporate Counsel Rick Abell, City Clerk Jan Adams, Clyde Wills and concerned citizens, Alderman Kim Brown was absent.


The meeting was opened with the Pledge of Allegiance followed with Prayer led by Mayor Billy McDaniel

Mayor’s Report:

The Mayor gave an update on the bridge on Metropolis Street saying that Jerel L Childers will bring the bridge up to code according to IDOT when he is finished. Mr. Childers will do the job for $10,710.00 this includes labor, materials and machinery use.
