City Council Meeting Minutes

At 7:00 p.m. on Monday, June 28, 2010 the regular meeting of the City Council, City of Metropolis, Illinois was held in Council Chambers of City Hall at 106 West 5th Street, Metropolis, Illinois with the Honorable Mayor Billy McDaniel presiding. Upon roll call the following Alderpersons were present: Nathan Anderson, Charles Barfield, Kimberly Brown, William Carrell, David Daugherty, David McManus, Robert Midnight, and Jerry Mizell. Also present were Corporate Counsel Rick Abell, City Clerk Brenda Westbrooks, Frank Walsh, Angie Shelton, Tera Temple, Steve Vantreese, Patricia Suttles, Jeff Crippen, Tom Pullen, Dr. Richard Trampe, Diane Grimes, Charlie Eichorn, Brian Giltner, Mike Worthen, Judy & Jim Penrod, Brenda Mizell, Karen & Kenny Laird, Rodney Brugger, Tim Niehay, and Jim Hall.

The meeting was opened with the Pledge of Allegiance followed with Prayer led by Mayor Billy McDaniel.

Citizens Request Time:
(Charlie Eichorn)
Mr. Eichorn gave the Council members another copy of the first letter he sent to the Council on February 28, 2010. He wanted them to reread it in hopes it would clear up rumors that are going around about why he brought up the subject of the City’s insurance cost. He said he never mentioned bothering retiree or bargaining unit employee insurance. He said he did see exorbitant cost in the City’s insurance that he feels needs to be changed.
Mr. Eichorn commended the Mayor and Council for appointing the insurance committee and he said he didn’t think the Mayor could have picked a better committee.

(Independent Advisory Committee – Mr. Jeff Crippen)
Mr. Jeff Crippen, who is the spokes person for the Independent Advisory Committee presented their final report to the City Council. Before doing so, he introduced the members of that committee that were present and explained why the other two were absent.
Mr. Crippen said the committee came up with an unbiased report and that all their decisions were unanimous ones. The goal of the Committee was to do a constructive review of the City’s insurance and make recommendations. He said they feel their recommendations are ones that won’t hurt anyone. He made it clear their goal is to help and not hurt.
Mr. Crippen did say that in his conversations with some of the Aldermen present that they feel they should be compensated for their committees, and he said that is fine but should do so other than with insurance. He doesn’t, however, feel they qualify for insurance since they are not full-time officials or employees. Mr. Crippen did say that he realizes the Alderpersons put in a lot of time with their positions but that is considered public service.
Former Alderman, Jim Penrod spoke up and said that Aldermen are on call 24/7 and if they are good to their people they take care of them on a full-time basis.
Mr. Crippen did not dispute that and said that is part of public service.

There were a few moments of contention, however in the end the Mayor and Aldermen thanked Mr. Crippen and the committee for the job they did. They did just what they were asked to do and their findings will be considered and helpful going forward.

Tourism Update:
Metropolis Area Tourism Director Angie Shelton gave the following brief update:
June has been a very active month for tourism. We just finished
having our 32nd Superman Celebration with over 30,000 people attending; all 50 states represented and several foreign countries.
With the unveiling of the Noel Neil Statue we received unprecedented coverage. CNN picked it up and did a story as well as the Associated Press. She said that Noel is turning 90 soon so she may not be able to keep visiting us and she is very grateful for the statue.
We just had the Archery Tournaments and Superman Classic with 99 new shooters this year. Angie said that the people are saying that Metropolis is their favorite place to come to shoot. She said the large prize money we had this year helped as well.
Last but not lease Angie told everyone that we now have a billboard up on I-57 South of Mount Vernon.

Citizens Request Time:
(Mr. Robert Lauderdale, Jr.)
Mayor McDaniel introduced Mr. Robert Lauderdale, Jr. to the Council. Mr. Lauderdale just recently purchased a home here in Metropolis on Girard Street and is Jared English’s father-in-law. Mr. Lauderdale told the Council that he is semi retired from the Navy and still doing some work for them but that he wants to open a business of his own her in Metropolis working on diesel trucks and trailers. He said that he would like the City’s support in his endeavor.

Mayor McDaniel told the Council that bills for engineering services on the George Rogers Clark Discovery Trail, like the two just they just voted on, will be coming in a couple of times a month. He asked if they want each one brought to the Council to be voted on or if he and CFO Patricia Suttles should keep tract of them, pay them and report back periodically to the Council so they are aware of the total amount being spent. These costs are reimbursable to the City but we have to pay them first.
The Council was agreeable to just be kept informed periodically on the total amount of engineering expenses for this project versus having to approve them each time.

Superman Celebration
Mayor McDaniel said he wanted to thank everyone, volunteers and City Employees, for any and all help with the Superman Celebration.
He said that if everyone noticed there was a map on display during the celebration and on that map it showed that every state in the United States was represented here at our celebration as well 9 foreign countries.
The Mayor said he felt we had a very good turnout and even on Sunday this year since there were more things going on longer on Sunday.
He said that Mr. Jim Hambrick’s auction that he has every year went very well. A signed shovel that was used to break ground for the Noel Neil Statue sold for $750.00 and a purse for $550.00.
The Mayor said that all in all we had a very good crowd with no big problems of any kind.

Landfill Equipment
Mayor McDaniel said that as everyone is aware of, the old dozer that we have used at the landfill with the burner has been broken for some time now and it will cost around $28,000 to repair it. That is a lot of money for something that old. Mayor McDaniel said that he has been checking with Army Surplus and they just sold a Case 621 B Loader for around $11,000 and have another one that we may be able to get for $4,500. Mayor McDaniel said that he is going to try to get more information faxed to him on the loader to hopefully be able to tell if it is something worth going after. He suggested that if he can get the information, he would send City employees to try it out and buy it for us. Then we would have to get someone to go and get it for us. Jerel Childers has done that for the City before and we could probably get him to go after it for us.
The consensus was to ask Mr. Childers if he would just go, try it out and then buy it and bring it back for the City instead of sending City employees. The cost to the City would probably be about the same.
Mayor McDaniel said he would try to get more information on it and talk with Mr. Childers about going to Springfield for the City.



Sports Park Update
Alderman William Carrell told the Councilpersons that the work on the Concession Stand for the Soccer Fields is going well. They are to pour the concrete floor this week.
Mayor McDaniel added that we have electricity, water and a drive to the building and if it dries up some we will have the sewer to it as well.




Abatements
Alderman Jerry Mizell said that do to the weather, the grass is growing fast and making it hard to keep up but he wants everyone to know that they are working on the abatements.

The Regular Meeting of The City Council, City of Metropolis, held in Council Chambers of City Hall, Monday, May 10, 2010 at 7:00 p.m. with the Honorable Mayor Billy McDaniel presiding. Upon roll call the following Aldermen were present: Nathan Anderson, Charles Barfield, Kim Brown, William Carrell, David Daughtery, David McManus, Robert Midnight, and Jerry Mizell. Also present were Deputy City Clerk Cherie Bush, Corporate Counsel Rick Abell, Frank Walsh Disposal Plant, CFO Trisha Suttles, Kristy Stephenson Treasurer, Richard Kruger & Scott Garrett MMPA, David Bowman, Tammie Bowman, Ron Bowman, Helen Bowman, Susan Bunting, Boy Scout Troop 101, Terra Temple, Jim Hall, and Steve Vantreese.

Mayor Billy McDaniel stated that we are honored to have Boy Scout Troop 101 in attendance tonight.

Mayor McDaniel said that the Council is honored to have you here tonight and please stand for the Pledge of Allegiance with the Boy Scout Troop leading us in the pledge and remain standing for prayer. He also stated that they are welcome to find a seat and stay as long as they want.

Mayor’s Report

Mayor Billy McDaniel stated that we as a city have many employees and that in everyday life we are proud of the job our citizens and employees do. Most of our employees do a dedicated job; however some people say that you are paying them to do that job; well that is true; but then there are occasions when some of our employees and citizens actually are in circumstances that can be disturbing to their own health and welfare in their jobs and they will go beyond that call of duty. More often than not they are doing it because they are a dedicated employee; then occasionally we have citizens that step up way beyond the call of duty and in this case here tonight I would like to recognize one of those employees.
About 2 weeks ago we actually had a weekend where we had a very young person pass away, which is always terrible in a city. Then we had a terrific accident at Mermet Lake which caused the loss of life there. But in saying that one of our employees that was not working he was actually on a recreation trip at that lake at the time of the accident when the car lost control and plunged into the water.
At this time I would like to honor David Bowman for his effort in what went on at the time of that accident at Mermet Lake. He put his own life in jeopardy to save the lives of the occupants of that car.
Mayor Billy McDaniel asked David Bowman to come forward to accept the award and he stated with great pride and respect for you we would like to issue this Superman Award to you for a super job and for being a super individual.
Mayor Billy McDaniel stated that this makes all of us elected officials very proud of employees that do things like this who never thinks of himself and we as a city do appreciate what he did.
Mayor Billy McDaniel stated that the next item concerned the Loan Request from the Port Authority District.
Alderman Jerry Mizell asked Mayor McDaniel if this is to be changed to an intergovernmental agreement and not a loan.
Aldermen Nathan Anderson and Robert Midnight expressed that they do not have a problem with going forward with this; but they do have some concern as to not having the terms of the intergovernmental agreement before they approve it.
Corporate Counsel Rick Abell stated that they have not discussed all the terms and that the agreement would have repayment terms in it possibly when they started making income leasing or selling off property. The MMPA just needs some assurance from the city council that you are going to approve going forward.
Alderman Robert Midnight asked if there was a way we could amend the motion based on approval of the terms.
Corporate Council Rick Abell said yes the motion can be amended and that he could certainly have some paper work here by the next council meeting.
Mayor Billy McDaniel stated that the MMPA needs to know that you are willing with the intergovernmental agreement. The following motions were made.

Mr. Richard Kruger thanked the Council and wanted to update them on the MMPA. He stated that we have organized and we have gone as far as we can without funds. We have a good group and we have met with several lobbyist and consultants. He said that for example to get the railroad to the site we need more information. He also said that they have met with several prospective industries and we have a letter of intent with a total of 69 jobs and investment of around $34 - $59 million and there is quite a bit of work that needs to be done on that.
Mr. Kruger stated that we have gone as far as we can with volunteer help and we need to step up the process. They appreciate your help and willingness to work with them. He stated that this has exceeded his expectations and that this is a real opportunity for the community.
Mayor Billy McDaniel stated that we have had more people and companies interested to come forward in the first 3 – 4 meetings than I had ever anticipated probably for the first year let alone the 1st month.

Corporate Counsel Rick Abell stated that in your packets there is a Resolution that had been discussed in the Finance Committee last week ; however we didn’t have the actual resolution at that time. He went on to explain that every couple of years we file a report with the EEOC (Equal Employment Opportunity Commission) regarding our employment statistics. He said I am certain that back 100 years ago we probably adopted a policy similar to the one we have here today; however we could not find it. When we went out to obtain grants thru the Department of Justice we learned that to be eligible we needed to have an EEO plan and it had to be current within the last 2 years. He stated that in all of our advertising we state that we are an Equal Opportunity Employer but to qualify for the grants we have to have a policy in place.
Corporate Counsel Rick Abell said that he and Trisha Suttles Chief Financial Officer went to the Department of Justice’s website and because of the size of our community they were able to use the short form and plug in the city’s information. Once data is entered they compare it to those categories in your state and county based on data from the last census; this gives you comparison data based on your municipality and the county as a whole.
Alderman David Daughtery asked if we have to just place the EEO Resolution or do we need to file it.
Corporate Counsel Rick said that we just need to approve it. He said that what those figures showed was that we have a significant under-utilization in the fire and police departments and the city as a whole in other areas we fared well. The EEO plan must include suggestions on how to address the under-utilizations and since by state law hiring for the police and fire departments is done based on testing we can look at our recruitment methods and make changes there.


Alderman David Daughtery stated that the hiring is done by testing and he realized that not everyone wants those types of jobs; but we do not have any minorities on the police and fire departments and he hoped that we can do more with the recruiting process making it possible to help more people qualify for those positions.


Corporate Counsel Rick said that those two particular positions stood out in pretty stark contrast and we realize we need to take some steps on this issue. Until you begin to look at the numbers, you overlook it, you don’t think about it. He said that truly, we need to think about our commitment on the recruitment side.

Corporate Counsel Rick Abell said that on the Department of Justice’s website there are forms for these types of plans and we can take some of their suggestions, such as talking to large groups and industries on how they do their recruitments and by placing employment opportunity information to where minorities have access to it. He said once we adopt this policy we can then take it to the Police & Fire Commission (which is a 3-member board) and ask them to look at it and understand that this is something that we need to do and we call upon them to do so. The Police & Fire Commission are the ones that control the hiring, promotions, and discipline for our sworn officers. He stated that the commission should be receptive to this and they have been involved in state agencies. After further discussion the following motion was passed.

He said that there was a question on giving a blank check. The names of the applicants and amounts will come back to the Metropolis City Council for final approval.
Alderman David Daughtery asked what year this was for.

Alderman Robert Midnight said it is for the 2010 – 2011.

He said that Verbal Blakey with BHM&G has some items that need to be discussed prior to the next Metropolis City Council Meeting. Possible dates for that meeting were May 20th or 21st

Sports Park Update
Mayor Billy McDaniel gave a brief update on the City’s Sports Park as follows:
All concrete pads poured
Bleachers put together and anchored down
Dugout roof completed and bleachers in them
Dirt Work & Net Work completed
Mayor McDaniel expressed praise for the City employees. He said he knows they get paid and always do a good job for us but they went way beyond the call of duty in helping with the Sports Park. Employees from the Water Department and Sewer Department worked very hard doing all the work to get the Sports Park ready for the ball season. They never once grumbled or said a negative word about being pulled off their regular job and having to do the work. Mayor McDaniel said they did a great job and he wanted to not only praise them but to thank them as well.
Mayor McDaniel added that he got to thinking on Thursday that the parking lot had not been striped and he could foresee all kinds of parking problems when the games started with people parking every which way. He called Pris Abell and Alderman William Carrell and told them his concerns and they all met at the Park and discussed the situation. As usual, Alderman Carrell saved the day with his great record keeping. He had a copy of the diagram of the proposed parking so they were able to get quotes from both a company and a local business man to do the needed stripping. Rodney Grentzer, who is local, said he could do the work and have it done by Friday for $2,000 which is the same as the out of town business said they would do it for. Mayor McDaniel said that he called and poled the Alderman for approval so he could get him started weather permitting. It will be on the next agenda to ratify.
Mayor McDaniel said that the striping of the parking lot is the last piece of the puzzle in getting the Sports Park ready for the ball season which will start next week. He said the park is something we can all be very proud of. It not only looks very good in the day but is very impressive at night.
The new soccer sites have been laid out again and Mr. May cut the parking lot down and formed the new site for the concession stand. The site location has been made for the new bathrooms as well.
Again Mayor McDaniel thanked all the City employees for going beyond the call of duty and the Alderpersons for their support.


Corporate Counsel Report

(STAR Bonds)
Mr. Rick Abell told the Council that they have an article before them from the Edwardsville paper regarding STAR Bonds which is a new incentive tool for development that was passed last year by legislature. He explained that it is where you can bond against sales tax revenue projected for a project and pay it with sales tax. He said this could be very beneficial to the City as well as others. It was passed last year but they are still determining the % amount.
Mr. Abell also pointed out that the article points out that incentives are a necessary part of business and that by reading the article the Council could see that we are not the only City doing incentives that they are a very necessary part of doing business.

Mayor McDaniel said that he talked with Carol Brown Hodge today and she has been in contact with the Comptroller’s Office and the checks are there to be signed and released. The Mayor said Mrs. Hodge can’t guarantee they will be here in a day or two but that they are to be sent out soon.


Tourism Director
Angie Shelton informed the Council that tomorrow morning people from ABC that are touring the state talking with people regarding projects funded by Tourism Programs will be here in Metropolis to speak with her and the Mayor. She felt this is not only exciting but will give the City exposure and free advertisement which is great.

Angie also told the Council that she and Gary Kidd met with a gentleman from Barkley Airport regarding the fact that 3 charter flights from Rockford, Illinois flew in and out of Barkley Airport daily brining people in for the Quilt Show. She said this may open other possibilities that the Tourism Department could tap into so they will be talking with Barkley Airport in an effort to develop something for the future.

Ms. Shelton mentioned that there will be an additional quest at the Superman Celebration, Carmine Infantino, who is a long-time comic book artist and editor.

Mr. Carrell also added that he worked daily with the City employees on the Sports Park and he said they laughed, joked and worked. He said lots of work was done and he too wanted to congratulate and thank the employees for the great job they did.

Alderman William Carrell gave the following update:
(Concession Stand Agreement/Massac Unit I School District)
Alderman said he wanted to go over the Concession Stand Agreement with everyone prior to voting on accepting it for the benefit of the Councilpersons that were absent at the last Committee Meeting where it was discussed with Massac Unit I School Superintendant Bill Hatfield and Mr. Lewis Bowles. He said he just wants everyone on the same page so we can vote and move forward with this project.


Basically Mr. Carrell said that the School district is to pay for the project upfront with total cost not to exceed $225,000. City to reimburse School District up to $150,000 over 3 year period at cost of $50,000 per year with payments due on or before March 31st of each year.
Mr. Carrell added that a Construction Committee for this project was formed as follows:

It was on tonight’s agenda to modify Economic Developer contract and compensation to make him an employee for the months of May/June 2010 without insurance benefits and with employee to pay all retirement contributions (employee/employer). However Mr. Abell is still waiting to hear back from Naperville on a similar situation they are having, to make sure there will be no legal issues involved. So this is tabled for now.









Old Business:


(Old Laidlaw Property Cleanup Update)

Alderman Robert Midnight reported that we are trying to get the engineering barrier done as required by EPA. It was laid out in accordance with EPA, but it was huge so we got in contact with Mr. Tom Miller and he came down and we looked at it again. In working with the EPA they have shrunk it and laid out new boundaries so we are back within budget and will be ready to go to bid soon.
There was a secondary area that EPA said we had to concrete but it turned out that it was in a building and is already concreted so they said we only have to maintain it.
And last but not least, Alderman Midnight said that the hole on the property that EPA would not let us fill and couldn’t treat, well, they have now said we can fill it with treated soil. Mr. Midnight said they are even willing to do the testing for free. He said that EPA is bending over backwards to help us get this project closed and over.

The regular meeting of the City Council, City of Metropolis, Illinois was held at 7:00 p.m. on Monday, March 22, 2010 in City Hall Council Chambers located at 106 West 5th Street, Metropolis, Illinois with the Honorable Mayor Billy McDaniel presiding. Mr. Boykin was present to give a short update on the consultant work he is doing for the City in Washington DC and Springfield.
Mr. Boykin said he is working on several issues for the City, one of which is the 12th Street paving project which he said they hope to get fully funded soon.
